We ask you to read these terms and conditions carefully before using Southern California Private Tours (also referred to as “we”, “us” or “our”) website.

The terms and conditions contained herein including any legal notices and disclaimers constitute the entire and only agreement between Southern California Private Tours and its website users (also referred to as “you”) and supersedes any and all prior or contemporaneous agreements, representations, warranties and all understandings with respect to the use of this website.

The use of this website is subject to the conditions stated below in this document. Every time you visit this website or use its services, you accept the following conditions. This is why we urge you to read them carefully.

Southern California Private Tours has no control over the weather or any theme park management. Should poor weather conditions cause any of the theme parks to close certain attractions, entire areas of the property, or the parks themselves, Southern California Private Tours cannot be held liable for actions or decisions of The Walt Disney Company and/or Disneyland Management. Refunds are not issued for poor weather and rescheduling due to poor weather conditions may not always be possible.

Southern California Private Tours cannot be held accountable for our guests missing or stolen personal items while on Disney theme park property during a VIP Experience. Guests are responsible for seeing to their own personal items during a VIP Experience, even when asking one of their Southern California Tour Concierges to handle that property for short periods of time.  (i.e. as when the guests are enjoying an attraction that does not permit or accommodate them taking their personal items with them.)

All guests participating in the experience must be 18 years of age or older, or accompanied by a parent or adult guardian. Southern California Private Tour Concierges cannot be held responsible for overseeing any individual younger than 18 years of age during the tour. VIP Concierges may be available to sit with a minor who chooses not to enjoy an attraction for the duration their parent or guardian is experiencing said attraction. VIP Concierges cannot be held responsible for the actions of the minor during that time.

Southern California Private Tours cannot be held liable for the actions or safety of any guest at any time during a VIP Experience. If at any time, should any Southern California Private Tours guest willingly or knowingly violate any safety rules or regulations as set forth by Disneyland Park Management, the experience will immediately be terminated with no refund issued. Any remaining days left to that experience (paid for on the same invoice) will also be cancelled with no refund issued.  Our guest’s safety is our number one concern.

 

For purchases made, we only accept payment through major credit cards. User represents and warrants that (i) the Credit Card information supplied is true, correct and complete and (ii) charges incurred by the User will be honored by User’s Credit Card Company and (iii) User shall pay charges incurred by the User at the amounts in effect at the time incurred, including all applicable taxes. User shall be responsible for all charges incurred through the use of the Southern California Private Tours Website Booking System & Telephonic Booking procedures.

All cancellations must be made no less than fourteen (14) days prior to the first day of your experience to be eligible for a refund (minus an administrative and planning fee equal to ten percent (10%) of the tour cost). All cancellations and request for refunds must be made in writing by email to tourdirector@socalprivatetours.com  No refunds are given for experiences cancelled less than 14 days in advance. Should a guest ‘no show’ for a VIP Experience, it will be handled as a cancellation with no refund issued. If you believe you are going to be late for your experience, please call the VIP Concierge assigned to you before the time your experience is scheduled to begin to avoid having your tour cancelled (their phone number will be provided to you with your meeting information).

The cost of a Southern California Private Tour VIP Experience represents the cost of the experience itself, and experience preparation. Guests are responsible for park admission tickets with MAX PASS option, food, souvenirs, or any other expense they incur during the tour.

Payment for guest requested reservations relating shows, meals or other activities that take place on the same day as their experience are the guests' responsibility.   Attending the above-mentioned shows, meals, or other activities are also the responsibility of the guest. Many theme park reservations made using a credit card to hold the reservation require a minimum of 24 hours to cancel to avoid being charged. Southern California Private Tours cannot be held liable for charges made to your credit card in the event that reservation times are not adhered to for said activities. Please be very clear with your VIP Concierge concerning your reservations so that they can help you accommodate them in a timely manner.

In order to keep your attraction wait times as minimal as possible it is very important that you show up promptly for your experience. Failure to follow these guidelines will mean longer wait times throughout your day. Southern California Private Tours does not, and cannot, guarantee that you will not have to wait in any lines. However, if you follow the lead of your VIP Concierge, we promise that your wait times will be as minimal as possible.

The majority of communication with us is electronic. Every time you send us an email or visit our website, you are going to be communicating with us. You hereby consent to receive communications from us. If you subscribe to the news on our website, you are going to receive regular emails from us. We will continue to communicate with you by posting news and notices on our website and by sending you emails. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing.

 

The content and services are provided “as-is,” “as available,” and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties or merchantability and fitness for a particular purpose). The sole and entire maximum liability of Southern California Private Tours, for any reason, and user’s sole and exclusive remedy for any cause whatsoever, shall be limited to the amount paid by the user for the particular service. Southern California Private Tours and any of its affiliates, dealers or suppliers are not liable for any indirect, special incidental, or consequential damages (including damages for loss of business, loss of profits, litigation or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. The limitations of damages set forth above are fundamental elements of the basis of the bargain between company and user.

 

We grant you a limited license to access and make personal use of this website. You are not allowed to download or modify it. This may be done only with written consent from us. Unauthorized use of this Website may give rise to a claim in damages and/or be a criminal offense.

In no event shall Southern California Private Tours, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and Southern California Private Tours, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

The linked sites are not under the control of Southern California Private Tours and Southern California Private Tours is not responsible for the contents of any linked site or any link contained in any linked site, or any changes or update to such sites. If any provision of this Terms and Conditions is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this Terms and Conditions unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court in California, United States of America and you consent to exclusive jurisdiction and venue of such courts.

By visiting this website, you agree that the laws of California, United States of America, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Southern California Private Tours and you, or its business partners and associates.

Southern California Private Tours shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms and Conditions without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms and Conditions.

 

Southern California Private Tours is permitted to revise these Terms and Conditions at any time as it deems fit, and by using this Website you are expected to review such Terms and Conditions on a regular basis to ensure you understand all terms and conditions governing the use of this Website.

 

Any rights not expressly granted herein are reserved.

All Private Tour rates and policies are subject to change without notice.
